I came to know about a start up which has just raised funding(not public news yet). It is a registered LLC(not in US). I know they have not trademarked the name. They have the .com already registered. The other extensions are just lying down.

Will there be any legal issues if someone registers the other extensions before the name is trade marked? The name is not a dictionary word but the name has already been used in an different context by someone famous.

Does that 'someone' have a 'legitimate reason' for registering the domain names in the first place, other than the fact that the .com is taken by a growing company ?
Just because they have not registered their TM formally yet, doesn't mean they can't already claim TM rights.

Katherine,
It is legitimate if the domain is used as an informative website. Let us call the word "xyz". The word "xyz" has been used in a different context. One can easily develop an informative website using the meaning defined in the different context. The same domain would obviously be more useful for the .com owner than to someone using it as an informative website.

The mere fact that you created this thread puts your "goals" in jeopardy. Any future litigation simply has to point to this thread to see your intent was to profit off a name. That intent alone is enough to smash you in a case.
