So I'm buying a tech domain that has been registered for 13 years. Its a very good domain.

I am planning on developing the site but saw that there's another site with the domain "Star-mydomain.com* which is a very popular site. I've searched the US and Canadian TM database and there is no trademark on mydomain.

I did a bit of research and star-mydomain.com is a sub-site of a major newspaper in Malaysia (Alexa rank 2,000).

I was planning on developing the domain but thought It might be worth it to send an email to the owners of star-mydomain.com to see if they want mydomain.com thinking I could make a very nice profit off it.

Do you think I could cause any legal issues by using mydomain.com even though I can't find any trademarks for it and I'm in Canada, they are in Malaysia? Do you think trying to sell them the domain would cause an issue?

Thanks

You don't have to have a registered mark to have trademark rights. Be careful about approaching a potential trademark holder about sale as it coudl hurt you later.....
