Wondering if anyone knew what the legality of typo domains are where it is not clear trademark infringement. Meaning, everyone know's what the NFL is. And their site is on NFL.com. If you got the domain MFL.com and put a sports related item on it would that be considered legal or illegal?

You can't say that the NFL has a right to every 3 letter acronym that ends with FL... but the NFL will say that the people landing on MFL.com were really looking for their site. Any thoughts?

I suspect that the MFL could, technically, be targeted as being 'confusingly similar' to their NFL trademark but it really boils down to exactly how much traffic (and ultimately, revenue) you are bleeding away from their site. I'm sure one of our more knowledgeable members that are domain / IP lawyers could provide more accurate advice.
