Please let me know if you feel this is an inappropriate question for a sales thread -- I feel it actually adds value to your sale, so I propose this question in public:

Could this particular service mark potentially allow the legal holder to pursue acquisition of the .com version of these domains? Current site is down, but archive.org shows that it has been in use by a US company since 1996 -- long before the US trademark -- but in possible direct competition of the use of this mark. I.e., if trademark owner were to open branch bank in the US under this name, I would postulate that they would have a legitimate case to acquire the .com version of this name from its current owner?

I assume that, however remote, there would be the possibility to acquire the .com domain. That makes this a potentially very valuable package, indeed.
