But I have a hard time seeing how this qualifies as trademark poaching? Clearly the intent of the name is not to take traffic that was intended for Myspace. I'm not too clear on all the legalities though.

I dont' see how you can appraise it. It might get a whole bunch of traffic one day or might get nothing for years. Even if it were to get traffic one day, it would be tough to monetize it from one lawsuit. Now if it were like a class-action or a whole rash of lawsuits started against myspace...you could make a lot of money.

Why sell now? Hold it for the next 11 months and see if it becomes a winning lottery ticket. It won't be worth any less in eleven months than it is now.

By the time its making money there will be a lawsuit and I dont think they will be worried enough about the website against them. Or for them....
