New clothing brand, need help

Im working on a new clothing brand and got ripwear.com
but when i finished the brand code it did'nt match the name...

i have most of the brand code in swedish but im going to focus on quality, design and to be unique. Im also going to focus on Urban creatives

"An urban creative is any individual that lives in an urban area and works in or contributes to the creative industries."

What do you think i should do change name or im really happy with the brand code so

Buy a Swedish IDN for reg fee .. Plenty of them available.

My advice is unless you got a lot of marketing money,forget it.....upto a third of the retail price goes on advertising on perfume for example.

I will start with about 5 t-shirts and got the money so no problem there, im just interested in sorting out the brand atm.

And why should i get a swedish idn, i dont want to limit myself to the swedish market. It's a very small market imo

You have limited the market all by yourself .. 5 T-Shirts? Repeat business?

I like the name, Ripwear.com its got potential, start small, if you get interest, get more shirts made, then pants, hats, etc.

lol i ment 5 different designs then 5 more (So a total of 10 design with 1000 t-shirts per design)

But i will do a test collection with 110 t-shirts

I'm new to TM regulations and such. But wouldn't RipWear (even though Wear is generic) have a TM issue with RipCurl since both are clothing? RipWear makes me think of RipCurl...

Last time I checked, RipWear sounded nothing like RipCurl. I can understand if they trademarked the word "Rip" in the description of clothing, but I do not believe that is possible. Than again, I am not a lawyer, so don't take my word for it.

So for a TM to be an issue, the two have to sound the same? How about AskSearch for a search engine? Both "Ask" and "Search" are generic; and put together to do the same as Ask.com, would that be a TM issue? :?:

In your definition, it wouldn't because RipCurl and RipWear both selling clothing wouldn't be an issue.

Anyone know the answer to this?

Did RipCurl trademark the term "Rip" + any keyword for any type of clothing related name?

To be honest, I have never even heard of RipCurl til you mentioned it... If he is not going to be selling any Surfing related products (He is not, it will be "Urban Wear"), I am going to assume he isn't going to have any problems and even if he did, I really don't think he has any problems as "Rip" is a generic term and is often used in surfing and many other categories.

But again, I am not a lawyer, so if he feels uncomfortable about it, he should consult with one.

Yeah, I'd have to agree for consulting a lawyer too. RipCurl is primarily a surfing brand, but you will see it being in urban communities as well (same as other surfing brands: Quicks*lver, B*llabong, etc).

It appears the only TM they have is "Rip Curl"

ripwear used to be brand so should'nt be a problem they used to have it tm'ed but canceled it.
But im looking for a new name atm, i dont think it will fit. Thanks for everyonce help

If you pick the former model, then I would try to make a one word brand name - see Threadless.com

But as of now, ripwear.com sounds pretty good too
