Putting names with possible trademark issues up at auction sites?

How common is it for names with, um, slight tm concerns to be posted at the usual domain auction sites and actually sell?

Has anyone here done it and how dirty is the practice? :?:

I'm talking about something like (example only):

[CellPhoneBrandName]2.com
 
It's very unlikely that an auction committee would approve such a name
especially with the press the industry has been receiving lately. Better off contacting domainers that buy TM stuff and asking for highest and best. Save yourself 15% at the same time dealing direct. Assuming the TM holder doesn't beat someone else to it with a UDRP
