Query about transfers.

I just tried to transfer a domain from namebay to enom but namebay rejected the transfer and said that if the domain is within 5 days of expiration then it cannot be transfered.

Is this correct? It seems a bit odd that the domain is still paid for and active but you can't transfer it out.
