Is it legal to "confiscate" a client's site, if they have not paid their dues (hosting), for a substantial amount of time? (6+ months).

If not, what do you normally do when in this predicament.
 
Their domain name? I would say that is asking for trouble.

However having a "hosting bills has not been paid" sort of lander is ok (IMO), if they are still hosting with you.
