While doing re-search to find a new business name for our company, we have made extensive research and finally came across a name which appears as a DEAD Trademark/Patent on http://www.uspto.gov/
.COM and .NET domains are available and up for sale @ a reasonably fair price.

Dead trademark belongs to security product making company which was acquired by another company in same niche more then 7 years ago.

This is additional information for same word from uspto.gov
Registration Number: (NOT available)
Standard Character claim: No
Current Status: Abandoned: No Statement of Use filed after Notice of Allowance was issued.
Transformed into a National Application: No
Registration Date: (DATE NOT available)
Date of Status: 2005-05-28
Filing Date: 2001-12-26
( i have edited the dates, which will not reveal actual information)

W are looking for some advice on same before we go ahead, we do not want to get into any legal problems in future.

We have also emailed the current company which acquired the old company but have not yet received any response from them.

It's clear that the application to register the mark was abandonded and the mark was never registered. The applicant filed with intent to use and they never submitted such documents showing use. The mark is dead as of 2005-05-28. Not only you can safely acquire the domain but you can also apply for a trademark.

for immediate feedback for our second reply, if any lawyer can full-prooft our requirement for a paid service if so, we will be more satisified.

Note: What in case any of assumptions/suggestions laid down are wrong ?
