uk / us trademark issue

hello,

I'll just say firstly I have starred out the name to avoid any legal issues untill I know where I stand.

I am a UK individual, who owns a uk domain name *****.co.uk, and I would like to trade under that name in the uk, (hopefully) profiting from uk individuals, however a us company owns and trades under the name *****.com, I have searched and ***** is a registered us trademark of the company, however they do not own any uk / eu trademark.

As I would be trading in the UK under a .co.uk domain, can I use this name? And do I have any right to apply for a UK trademark of the name ?

Countries have been known to recognize others TMs. It would be solely dependant on the name and usage of the name involved. It is possible for 2 companies to be known for the same name (Apple computers, Apple Records), but you would have to be in different catagories. If you truely want to use the trade name in hte UK, get legal help there and have someone look at it for you.
 
Best advice anyone could give. You should definitely consult a UK trademark lawyer.
