On 4/25/2012 the DNForum member Campbell1990 - http://www.dnforum.com/member-campbell1990.html - made a direct offer via PM for one of my domains which I accepted.

Because of his lack of any trader feedback, I asked him to place the offer again on Sedo and he did. I then sent the domain to auction, as he asked to pay several days later and I informed him of the process. I did not promote the domain auction directly or indirectly to any other parties.

Only a few hours prior to the end of the auction, Campbell1990 sent me a PM saying he had a car accident and he's being sued for lack of insurance, asking me to end the auction. I asked Campbell1990 to provide a scan of his id and that of the police report as I did not buy his sob story. He did not respond.

The auction ended on 5/3/2012 on Sedo with the domain being sold to Campbell1990 for the amount of $7,000.

To this date, Sedo has not received payment and they are moving the case to Accounts Receivable. As soon as his information is released, I will publish it here.

I reserve the right to then take legal action against Campbell1990 for breach of contract and to seek further remedies beyond the amount specified in the contract, plus legal costs.

Wait, he made an offer, you accepted, you then asked him to transact via sedo, which he agreed to, you then decided to push it into an auction, you think that wouldn't tick a buyer off?

He made the offer on 4/25 he said he'd pay on 5/4. He did not object to sending the domain to auction on Sedo. The auction ended with Eric Steven Campbell as the sole bidder. A few hours before the end of the auction, he sent me a PM claiming he's being sued for rear-ending someone's car.

* You asked him to place an offer via sedo, the way you state it afterwards is you pushed it into auction, and informed him of the process, the fact you did not directly or indirectly promote the auction, what is the point of stating that, if you didn't feel guilty of pushing it into auction.

If I made a deal with someone on DNFORUM, and they asked me to place an offer via sedo, because they didn't want to handle payment, and processing, I would be ok with that, but pushing it to auction, and me potentially paying more, that would not be cool. I think 9/10 buyers would not like that, he probably agreed to it, most likely because he got caught up in the hype of domaining without checking his financing first. I think sedo caps credit cards at $5k, so maybe that was an issue, but it always sucks to lose a sale, hopefully you get more in the future.

I appreciate you playing 'devil's advocate' but the bottom line is:

Eric Steven Campbell did not pay as per his contractual agreement.

It's unfortunate we have people like this who don't follow through on their word.

Unless you sue him in small claims (which is limited to 5K) your going to spend well over 7K suing him for your 7K, so no matter how look at it, your not going to come out of this WHOLE.

Thanks Raider. My initial move is to have him banned on DNForum, as he's banned on Sedo already. Obviously, there are many ways to enforce a contract and I will be looking into this in due time.

He had plenty of opportunity to decline the domain but decided instead to go all the way to auction and agree to whatever steps were taking place between the two of them.

The fact that he did not respond to my request to provide proof of id and a police report, shows that his car crash story was bogus. He did not even have the decency to respond to my request and he logged on numerous times since.

At any rate, I did not waive my rights to pursue legal action even if it were true. When one makes sizable offers, they'd better have the money in the bank to back them.

I agree that fabricating a story that can be verified is NOT the excuse you want to use... If he over obligated himself, what's wrong with saying "I over obligated myself and I don't have the money"? Pride?

This might be a old school thing to say, but "Honesty" really IS the best policy... People respect you when your honest and disrespect you when your not.
