I noticed that a copyrighted name is about to drop due to expire, is it a mistake trying to backorder and win this domain?

TM domains drop because of one reason:
1. Owner comes to his or her senses and learns that the he/she can't sell the TM domain to the TM owner.
2. Owner got hit with a UDRP.
3. Owner got hit with a lawsuit.
4. TM owners contacted the owner.

That is correct. A lot of times the trademark owner isn't the one dropping it, it is someone else that registered it and came to their senses.

Registering trademarks is no good. It gives all domaining a bad name and is highly frowned upon by any real domainer.

if it is any good, you probably won't be the only one trying to catch it

simple answer to this is Character. There's a fork in the road choose your path.

*unless you can show a legal or justified reason why you have the right to own it.

Trademark infringement comes from improper use, not the domain.
There are multiple trademark classes (I believe 45?)
Buy the domain, if you want it for a use other than the trademarked class.

Buying a TM domain for any reason, is alot like shooting yourself in the foot on purpose.
