It's not a TM, you can't TM a name, right? Yet, I think those names are easily taken away. Why?

And secondly, where can I read about all this TM stuff in plain English, like nicely summed up and explained?

Wrong. You can trademark a name.

It's not just their name, but their business they operate under.

You can buy their name, but only keep it if you got it long before they became famouse. But then again, you wouldnt know enough to buy it then. Unless you made it a practice of regging random names of people that werent already known.

.. or you have (or know someone who has) the same name.

what about running fan site (with no income or profit) - can they still take it away

I guess you have no legitimate use for the domain and are just trying to profit off their brand.
