For the mods etc.

Just had some unsolicited legal advice, I assume from a forum member.

As Rico accepted a change in the deal, i.e. agreed to to pay all escrow fees, then that is an accepted change in the original post where it was $1500 split fees.

Once Rico had accepted the change in the sale ,which I believe he did?, then we are both back in the running. If that is the case then It would appear that I was the first to agree to $1500 plus escrow fees.

I am most certainly not a lawyer but the above seems reasonable to me, biased as I am. Perhaps there is a lawyer on the forum who may clarify this?

Anyway, whoever it was that emailed the info, what ever the outcome thanks anyway.

There shouldn't have been a change in the deal, that is the point. He posted sold. First to post or PM sold without making an offer should get the names. The post did not ask for offers it was a firm price.

Why would you do that? That is a greedy move. That's not what you posted. It seems Rico was the first to agree to the posted terms and not PM an offer. If I am reading correctly, Rico should get the names.

Next time price your names higher Arsenik and you won't have so many upset bidders!

Another way to word it would be "minimum acceptable bid is $1500 and I reserve the right to accept higher offers too."

One problem here is there always seems confusion about the forum name saying 'fixed price and offers.' Many post names here with no prices at all, others say accepting offers only, and other sellers assume they must post a fixed price only. Which one is it anyway?

The exact terms of the sale as quoted originally were:-
$1500 for all 3 - Escrow (split fee)
Rico accepted those terms and posted "Sold" so was the buyer.
Anything outside of that was outside of the sale in this DNForum thread and as such would not constitute part of this sale.
Should anything continue outside of this forum then so be it but in my personal view members should abide by the agreed terms of their sale - neither sellers nor buyers should attempt to "up the sale" after an agreed purchase.

I assume then, that irrespective of any legal views that may or may not be correct, the mods decision is final albeit possibly above the law?

Are you saying that you did not accept a CHANGE in the terms and conditions by agreeing to $1500 + escrow fees?

Wot was the first to reply to my pm (only by an hour) saying he would accept to pay 1500 + full escrow fee. I received many offers and i am trying to be fair as i can. If the deal doesnt work out with him you will be the next in line if you are still interested.

Looks like you already admitted it does it not? That changes the terms and conditions of the sale .

Suggest neither you nor Arsenik proceed with the sale as I am now taking "proper" legal advice, and that's that!

Whatever, I now have all the information my lawyer requested on this thread.

I beleive he will now be dealing directly with Arsenik or his representative and I will be making no further comments on this thread as per my lawyers advice.

Whoever posted or PM'd sold to the original terms (you cant change them) should get the name and their should be no legal problems.

Where did it say that the mods decisions are above the law? No one is stopping you from getting an attorney, and nobody is forcing Arsenik to do anything. The fact is, the first person to agree to the terms without making an offer gets the names (as many have said, not just mods), that's the way this forum works. You guys have to work it out. Arsenik should do the right thing, and honor his original terms. Based on what's been posted as proof, the first person to post sold to those terms was Rico. If he sells to someone else a lot of people will not bother posting in any of his sales because who knows what posting sold means to him.

You were negotiating with arsenik wot, and didnt want to pay the full price at that time.
I agreed with arseniks terms, and after that you came up another offer.
If you just agreed immidiatley with arsenik, the names were yours.
