A Cease and Desist calling upon a "Common Law TM" as rights conferred from use of a word or phrase in the last year or so?

Attorneys and others please advise.

I quote directly form this site:

"Common law trademark rights are limited to the geographic area in which the mark is used. Thus, if a coffee blend is sold under the name BLASTER in California only, the trademark rights to that name exist only in California. "

At first glance it appears that Common Law TM is state-specific. I am having a hard time applying this to an internet site which apparently is visible to the entire world.
