.COM owner prepared to take legal action against me owning the .CO

The owner of a .COM domain wants to take legal action against me unless I transfer the .CO version of their domain to them.

What rights do I have as a consumer?

Well, that is all part of the hype and salesmanship behind the promoting of .co...its like dot com.

So, many people regged names they had no business (literally...no business) owning.

This is nothing new and nothing different.

This is the consequences of taking of or abusing of someone's else's property. I am not saying you did anything wrong because I do not know the name in question (and I DO NOT want to know the name).

But, if you did take another entity's legally trade marked name, then there is no point in asking what rights you have.

Yes, most likely.

But doing it and then acting all innocent about it is another thing.

If it is a blatant TM name then give it up.


The downside to this whole .co (and .cm) was being heavily promoted as a typo for .com. That is where many seized the opportunity to cash in on some high profile/high traffic sites.

I get tired of the Whaaa? Me? What did I do? after someone is caught.


On the other hand, if it is not a TM and someone who simply wants it because it is the dot co, then screw them...

I dont think its a trademark, they are a company based out of the US and i am in Canada. They own the .com I own the .co

Sorry, it does not matter where you are located. A TM is a TM. Look up the Madrid Protocol regarding internationalized TM protection.

May be you try to negotiate for some amount of money rather than just giving it up. They would be willing to pay some money because legal action would also cost them considerable amount of money.

It depends on the exact domain. The name doesn't have to be a registered TM for them to have valid claims.
