For Sale delete cycle + working?

Is it normal for a domain to be in the delete cycle and working at the same time?
I have found 2 or 3 like that.

Some can last for months after expirey - especialy if the domain is hosting sites as a name server, but it does expire.

The thing is how the domain owner knows his domain has expired? He just wakes up one day to find his domain used by someone else?
Well his registrar must have send him an email about renewal that he probably ignored or has changed email address so finally it's his fault.

renewal dates are often ignored or their webmasters are just too busy, happened to me a few times to. Some of the domains I use SnapNames for are mine.

I know domains that expired last year and are still up and running. Makes no sense to me.
