Well, its a risky business. Generally, to avoid hassle, the companies involved will buy the domain as long as you don't get greedy. If, however, a very large organisation wanted to hang you out to dry to make an example of you, the potential damage is probably more than most speculators could sustain. ICANN is not the arbiteur of Trademark violations, so loosing your domain is the least of your worries if things get heavy.

I know this is the case, I run the risk with lots of typos and potential law suits....I just thought it was a bit hypocritical of Sarcle to post that comment when he himself posts simlar domains for sale at prices above -$400

Well sure there is money to be made and nothing is without risk. I made comment on this, as Disney is one of the companies, I think you might regret crossing. Personally, I stick to Generics, in general. I know that I am not squeeky clean either and there is always a grey area with the law, but this particular domain wouldn't leave much wiggle room.

point is.. If you, yourself was in this type of business at all, no matter what type of typo names you are running the risk.. Same risk. Now whats the use of telling another guy whose doing the same thing something that you should be telling yourself.

No a Generic is keyword that cannot be Trademarked for its main and orginal meaning, so there is little risk. No one can Trademark dictionary words unless they apply it in away that has no bearing to its dictionary definition. Typo of trademark such as Disneyland run a completely different level of risk. That is just one of the reasons why good dictionary dot coms are so valuable. Typos of such words are also pretty safe. Domian.com for example would be fairly safe as the owner of Domain.com has very limited rights over the word Domain, but what does he care when he has the best brand in the business.

I would think you would be ok unless you are trying to pass yourself off as disneyland. I have expereinced letters from a lawyer and when they see all i have is the pages parked they close the case. It all depends on what you want to use the page for.

I think that is likely to be the common experience. However, imitation is a major concern for a few high profile players. They literally get thousands of people trying to rip of their brand. Often the way they deal with it is address the problem very robustly with a single individual, most of the rest then get the message.

First off this thread isn't about me. I am merely letting this person know the risk of owning a domain like this. I am not telling this person that they can't do what they want. I could care less really.

Sarcle, wasn't a dig at you really...just the way in which you scripted the response.

Saying the domain had less than no value, when infact this is not the case...although the domain has legal issues, people are still prepared to buy/sell TM infrigment names based on revenue (As you and I have done in the past).

Simply stating that the domain is worthless isn't a true reflection of how some (granted, not all) people would value this domain....a fair amount of people would buy this domain if it was making $x amount a day based on a risk/revenue model.

No harm intended, just trying to get this point across :)

Actually, I don't think there are TM issues here, the Overture is so low that it would be difficult to argue confusion!

It really makes me wonder why you guys mess around with this. We are able to new register generic keywords in local character strings that do more Overture than the magic kingdom does genuine or fake!
