Google prevails in domain name dispute

Date: Monday 14th September 2009
Search firm Google has prevailed in a domain name dispute with Absolutee.

The company approached the National Arbitration Forum (NAF), which deals with domain name disputes on behalf of the Internet Corporation for Assigned Names and Numbers (ICANN), asking for the organisation to transfer control of the web address GoogleWebMarketing.com.

Held by Absolutee, the web address in question was registered on May 19th 2008.

The company offered web design and marketing services, such as search engine optimisation.

NAF noted that the term GoogleWebMarketing was not used on any other part of the website and was merely a way of taking advantage of Google's reputation.

The NAF also said that the domain name directly infringed on Google's trademark.

"Having established all three elements required under the ICANN Policy, the panel concludes that relief shall be granted. Accordingly, it is ordered that the googlewebmarketing .com domain name be transferred from respondent to complainant," the NAF said.

According to the Corporation Service Company, domain name recovery costs firms £133 million more each year than it should do.
