While I understand the point of the comments that were started, DNF still has rules about not posting derogatory remarks in anybody;s sales thread. I think that these comments would make for a good discussion, hence that is why I split the thread and moved the relative comments to the "Domain Reselling" section.

I will offer you -$30,000 for the Lamborghini domain names; that's right, YOU pay ME to compensate for the trademark liability.

I am not crapping on anybody.

I am just getting tired of cybersquatting, because it makes my life miserable. It brings the heat down on small entities.

And it does no favor to your fellow community members who don't deserve to pay $30, $50, or $100 --so they can be sued and risk losing their homes and life savings.

Selling famous registered distinctive trademarks should be against the TOS of DNF. If it isn't, DNF management should look at this matter ASAP, to protect their own backsides if for no other reason. If trading in those names isn't against the TOS here, I wouldn't be surprised to see liability attached to harboring a den of thieves where people freely break the law.

I don't appreciate being called a thief and for your knowledge the site was used for nothing more than a redirect page to Lamborghini's own website. It was nothing more than a showcase of their cars and the pictures used were done so with permission of the owners of lamborghini.com. I have no intention of breaking any rules and made sure to work things out with the company first to make sure i wasn't stepping on anyones toes. As long as the site was used to redirect to theirs they had no problem with it. Now as far as crapping on my thread calling me a thief constitutes doing so. Please take your personal attacks elsewhere.

DotComCowboy, britishangel has the right to sell any domain name he wants. If someone chooses to buy it, then that is there decision and britishangel can not and should not be held responsible for there problems. If you do not want to buy his domain names, and or dont think any one else should, that does not give you the right to destroy his thread. Please try to be less confrontational with your posts, and please mind your own business.

I suggest anyone who makes negative comments in sales threads be banned. As you aren't a lawyer acting for Lamborghini, your opinion is just that - your opinion.

Some of us are sick of seeing sale posts ruined. There are a number of domains listed that you have subsequently sabotaged, so perhaps you should compensate the seller, as you've breached the rules of the forum?

If you have a problem with the items being sold, PM the seller or notify the Moderators if necessary, keep your opinion out of the thread.

There are no DNF rules for trademark names but their are rules about being nice to people - NamePopper thanks.

Enforcing such a rule would be IMPOSSIBLE. There is absolutely no way to know every trademark out there. Furhter, just because a name is TMed, does not mean you do not have a legitimate interest in the name.

Examples:

Jolt.com - This is a famous trademark, however it is a generic dictionary word. There was a WIPO case on this name in which Ari Goldberger successfully defended the name.

Ponds.net - I own this name. There is a huge facial cream company called "ponds". I love ice hockey and play a lot of pondhockey. I have a legitimate interest in the name, and Ponds, Inc, does NOT have exclusive rights to the name.

Yes, there are the obvious anf flagrant TM violations. There are a lot of lesser known TMs as well. I have another name that I am trying to sell. A potential buyer looked it up and said there was a TM on it. I have never heard of he company. I would doubt anybody else here has heard of it either. Does that make me a theif?

If we were to attempt to enforce this rule, who would take the time to do a TM check on the hundreds of names that are posted for sale daily? Simply put, it is impossible. This is the EXACT same reason why registrars MUST display the URDP on their site. Are registrars at fault (and hence THEIVES) for allowing these names to be registered?

While I understand your point, it would be impossible to enforce. Unfortunately, the onus is on the buyer to to research the possible TM consequences of any name.

I am going to split this thread so British Angel can get back to her sale without having anybody CRAP. We DO have a policy against derogatory remarks in any sales thread. We **CAN** enforce that.
