I am wondering about Nominet, the body that registers .co.uk addresses.

Is there any legal reason that would stop:

- Nominet
- Someone who works for Nominet
- or someone outside of Nominet working with individuals within Nominet

from registering expired addresses without letting them be made available to the general public for registration first.

Please note that I am not suggesting that this has ever happened, or questioning Nominet's credibility in any way. I am am asking whether there is any legal framework regarding the way Nominet has been established that would stop this behaviour.

I've thought about this idea in general many times. I'm sure it has happened before (by someone at some company).

"Legal reason"... hmmm.... one contractual provision of a TLD delegation is that the delegate should abide by relevant RFC's, which would include RFC1591. That would be an issue between IANA and the ccTLD manager, and would not provide a third party right of action, though.
