I need legal help in virginia court on motion for Default Judgement.

Dear Anyone!

I'm Jinsu Kim from Korea.

Anyway, one of my domains is on virgia court in usa and korean court.

I failed to defend it at adndrc.org. and so I filed a court in korea. my registrar(godaddy.com) accepted korean court file. but the opposite company filed a court in virgia too.

I couldn't join and submit english response in usa.

I just have tried to defend it in korea court.

But I got emails from the complainant lawyer about motion for Default Judgement. I didn't know what is Default Judgement.

There is a hearing scheduled for March 21, 2008 at 10:00 am before Judge Buchanan at the United States District Court for the Eastern District of Virginia, Alexandria Division.

I know that time is not enough to solve this situation in virginia court.

Although I lose in lawsuit, I want to appeal against the decision and more appeal to the Supreme Court.

There are many problems to attend virgia court from korea.

Any need helpful advice for me ?

Default Judgement means that you didnt appear in court and therefore do not intent to defend your case, therefore the judgement will be made in favor of the person who has appeared in court, leaving you with losing your case...

Anyone from Virginia, who can help him make an appearance there...? Pls help... since he intends to fight the case all the way, don't let them take his domain due to default judgment.
 
what about video/phone conference- should be possible
 
Unless you get an attorney, you are stewed...The 21st is around the corner. I would call Stevan Lieberman asap. He's in Washington, DC about 35 minutes from Virginia. He strategically moved his office there because it's where near Herndon VA, where NetSol and Verisign are hq'd for the purpose of cases against them that end up in that court.

I want to call them, but I can't hear english well. Anyway, I'm looking for a good lawyer to work upto highest court(supreme court).

Obviously the .org is not the domain in question as a simple whois reveals it's the Asian Domain Name Dispute Resolution Center. What difference does it make anyhow?

I looked at the .org domain that was in Korean except "website under construction". Seemed odd, someone would fight for such a name.

In any case, never mind. Good luck with the case.
 
try putting the www in front of adndrc.org
 
I had the same position with a corporation in USA issuing proceedings in the USA Court. I faxed to the Judge and he agreed to hear all parties on telephone conference. Eventually I filed witness evidence from UK to USA Court and the Plaintiff then settled the case with me, subject to confidentiality so dont ask.

try putting the www in front of adndrc.org

I always find it amazing how some webmasters and site owners are willing to lose traffic and do not understand the importance of taking a few seconds to make a minor adjustment to the server settings so it resolves either way.

Steven Lieberman require me to pay expensive money.

But He is reliable i think.

He works on an hourly basis of $350 per hour.

Anyway thanks for all posted people.

"Expensive" is a very relative and subjective term.

When an attorney undertakes to represent a party in court, that attorney cannot withdraw from the matter without the court's permission.

Accordingly, an attorney who does not require an initial retainer payment is going to end up doing a lot of work without ever getting paid.
 
Dude, you went from wanting to take it to the supreme court at any expense, to $350 per hour is too expensive! If the name isn't worth a few thousand dollars, forget about it.
