Whois, at the very top of the page you referenced, it says

"Thus, the policy uses "we" and "our" to refer to the registrar and it uses "you" and "your" to refer to the domain-name holder."

Icann is putting the responsibility on the domain buyer in that section.

Cambler, I had the same thoughts as well. In the case of dropped domains, a drop-catching service actually registers the name themselves and then resells it to the high bidder. So I am sure that those drop-catching services make you agree to a clause that idemnifies them in case of a dispute. However, the question is: does this clause hold water? That's where our legal experts need to step in.

Last time I checked I didn't have rabies. Before you sold it you were the registrar and the registrant. This game changes all the time and by the time it does you will have made your money.

What puzzles me is why would any buyer risk their capital on a potential TM issue?
I can see someone paying a small amount with a limited financial risk ( worst case turn the name over) , but to shell out big bucks for these names is foolish IMO.

You can't possibly think that you will keep this name can you???
There must be hundreds of names for sale out there that 20k could have bought
with long-term potental and no issues..
