:( ahhh.. really sad :( .. does anyone have a link to the court papers? ... isn't this what Internet Commerce is all about - helping domain investors against corporations like these?

.. where did the domainer make the mistake? .. published a lambo related information on the lander?

does someone have a link to the court case?

.. it seems we are loosing some rock-solid argument winning from the Lamborghini lawyers why this was a "bad faith registration".. especially as it was bought in aftermarket for $10,000 (not hand-registered).. as I understand this.

.. I'm not a lawyer.. there must be something that can help us (large and small domain investors) to understand better why this specifically ended in loss for the domain investor..

.. or was it the simple - investor couldn't properly protect himself legally?

It seems the main point that didn’t work in Blair’s favor is that “Lambo” is not a dictionary word that can be used according to its generic meaning.
Even if he didn’t put an active website on the domain, the primary reason for buying it at that price was clearly to benefit from the company’s worldwide fame.


It was also very difficult for Blair to prove that he had no intention of selling the domain to Lamborghini, especially after listing it for $75 million. If Lamborghini didn’t exist, he would never have priced it that way — and probably would never have bought it for $10K in the first place.


And as we all know, UDRP always protects famous trademarks more than any other category, which made this case even harder for him to win.
