Here's a question for any lawyers lurking in this forum:

Are previous owners of TM domains also vulnerable to lawsuits? In other words: If I sold a TM domain, can the TM holder sue both the current and previous owner(s)?

Yes, It can happen. How often it happens? I can't remember there ever being a case. But I remember a situation such as this in the early stages (money demanded), but I cannot recall if there was an outcome to it.

Just because we sell a TMed domain does not relieve us from liability. What is worse, if you sell a domain after receiving a notice, then both the TM holder and the buyer can come after you. Remember, squatting is the practice of making money from a TM to which you have no rights. You sella TMed domain, then you made money = bad.

Well I'm not answering in both.

I've gotten quite a run of emails lately where people ask me questions and, if the question admits a straightforward answer I give one; and then the folks want to write back and argue with me about it. I sit there and wonder, "Why'd you want to know what I thought in the first place?"

Might be time to add a disclaimer in your emails like, "Warning: I give brutally
frank answers. Don't bother replying if the truth hurts." :D
