I don't think they're going to get it... if they're trying to get the domain?

Their company name is "WINE & DINE PROPERTIES, LTD." is it not? So maybe if they had the domain, wineanddineproperties.com theyd have a case?

Wine and Dine is pretty open, I don't see them winning that name,.

It really doesn't matter what their company name is; a company can hold as many trademarks as it likes. The trademark is for "Wine & Dine", which they've had since 1995.

I'm not going to say that I think they will win, but you never know.

You'd like to think that completely generic terms or common phrases would be safe territory but names like this have been given to the complainant before...:disappointed:
 
Did Marchex have links to "food and beverage" magazines?

The term seems like a pretty weak TM.
We used the phrase as teens as a means of getting some sex.
They should have put up a site pointing to AFF.

I can't understand how can the company get the domain.If it was reg'd by someone else that's there own neglect.what if the domain is intended to serve other purposes other than "wine and dine properties"?

Yawn... nobody ever saw the complaint? Nobody knows what the claims were.
 
Well guys, looks like a false alarm for now. The case was dismissed within a couple days:

"Civil Case Administratively Terminated. Case opened in error by counsel. (MJZ) (Entered: 09/22/2008)"
 
Am I ignorant, or is "Wine & Dine" a generic term?
 
brendan's name is there. i hope he isn't shot down in it all.
 
$25 million is too much . They are so greedy bastards.
