I got the down low on mountain dew, and I did call pepsi to verify this rumor before I bought the domains. They gave me the name of the new mountain dew coming out.. then I regged the names. I talked to friends about copy right issues, and they all told me i was f-cked.. so I paniced. I called pepsi and requested to talk to the head webmaster of it all. They took my name, adress, phone #, email, ect. They are emailing / calling me within 24-48 hours about if I can keep the domains of if they will buy them or what.. The guy I talked to said they probably will NOT WANT the domains.. so here they are.

PitchBlackDew.com - ?????

PitchBlackMountainDew.com - ?????

Umm just emailing them kind of screwed yourself, you could have said you registered them for a different use and never even knew about the product (except for the one that contains "mountaindew", they could take that at anytime due to the obvious trademark). But now they have emails of you admitting to registering them and asking if its a problem. If they ever want them, they will get them.

Money wise, I don't see any value in them unless they get type in traffic.

The soda is coming out in October.. big typein there I'm hoping on both or one.. huge type in.

By the looks of it.. they dont want them. Thats what one of the guys was saying..


Also - it was on the phone.. no emails yet :)

you will be lucky if Pepsi doesnt sue your ass off...

you should have deleted the domains right away, they wont be worth anything in the best case scenerio...and could cost you thousands in legal fees and damages

they aren't going to sue you as long as you hand over the domains if they ask for them.

the first domain you listed, PitchBlackDew.com, implies that the new name of the product is Pitch Black Mountain Dew or Pitch Black Dew.

The second domain implies the name is Black Mountain Dew or Black Dew

here is the problem...

an appraisal is pretty much impossible at this point because...

a) there seems to be a clear case of infringement, meaning the legit tm holder can probably take the name anytime they want to = $0
b) you have already said you will give them up without a fight = $0
c) any value that comes from typeins will become a liability to you = $0
d) the price for a traffic name would be derived from actual traffic, not speculation = right now, $0

In the upcoming month of October, the soda will be released and you know know that that people will search for it then. I think the OVT will be nice and high by that time, because people are already searching for it (0 ovt right now).

Do you guys think someone would buy it if it had OVT, and I cleared everything up with Pepsi / Mountain Dew and I still have posession of the names? I personaly do. PitchBlackDew could be a normal website as well as an informational site / traffic site.

i'd give the domains back and run. You won't make any money off of then cause you'll get sued by Mountain Dew. Just admitting to them that you registered it is bad. I'd hide if i were you.
