Apparently Seller was threatened with Suspension were he to remove a domain listed in an upcoming auction.. Which is over a week away.

I have explained the issue in my first post. I was even told that any domain listed for sale at Sedo, in auction or not, must be sold through Sedo..... ... Anyways, nothing more to do about it. :disappointed:

If that is the case that ANY domain listed with SEDO is not allowed to be solicited anywhere else then this means EVERY member on this board is breaching the T&C's

(This has no bearing on offering the domain for sale elsewhere)

I think SEDO were trying to scare you into them getting a commission. The fact that you list elsewhere is not a breach as this refers to contacting previous bidders or contact other members whos information has been obtained via SEDO.

I think your SEDO agent is reading something into it that is not actually there and they have misinterpreted their own T&Cs..

as an aide memoir, GreatDomains T&Cs Link directly to SEDOs T&C's and you would be governed by them.. which means pulling a domain from SEDO or FROM GiantDomains is perfectly within your rights.

Quote SEDOs T&Cs

(g) The Seller agrees to keep any data which he/she has added to the Domain Marketplace up-to-date. If a Domain has been sold, he/she is to remove it from the Marketplace.

If you want to get pedantic you would be in violation of DNFORUM terms of listing a domain for sale.

Seems to me that this deal boils down to doing the right thing. Namestrands bid and won the name in an auction started here by the seller himself. Namestrands has no control over the seller having an auction somewhere else, only the seller has control over that. Namestrands hit the BIN and seller agreed to sale. Sellers need to make sure names are available for sale before they attempt to sell them. Sounds like the seller should deliver the name to Namestrands once he pays for it.

Unfortunately, I have not been able to cancel the scheduled GreatDomains.com auction for okf.com . After a long talk with several Sedo staff I have been told that "Soliciting a sale outside of Sedo while the domain is listed for sale with us is a breach of our terms and conditions." and can result in me having my Sedo account suspended. I am not willing to risk this and therefore the domain will be auctioned at GreatDomains.com the 29th of november as planned. When I scheduled the domain for auction, I was sure that I could cancel it from auction at anytime, as long as the auction wasn't started yet. The problems that this would cause has made me think again next time I want to list one of my domains at Sedo.

I apologize to those who has made offers for this domain and I hope I didn't waste too much of your time. :)

In the future to all those involved with external auctions, please READ all clauses of that marketplaces' restrictions.
