note: that it cant be used to sell books or photography related because someone else has the
right for that, but it is good to sell other stuff.

It has:thousand of backlinks in yahoo and Google
all are solid links. It was a respectable site and the links are for qulity sites that have been gathered for more than 3 years.

starting bid: 1350$

There were legal issues:
we received a cease and desist letter from Harper, Collins Publishing Company for using the name A Day in the Life. We where running a photo site up there and, apparently, they have a series of books called A Day in the Life. They have a federally licensed trademark on photo-related media using the phrase "a day in the life..

However if you use the site for something else you should be in the clear.
It was a serious site with very solid links it was closed because of what I mentionesd before.It would be a shame to let it go.

Interested, but need more clarification on the legal problem. Does this not mean you can use photos to market the site, or just that you can't sell photo products/services?

if you sell e.g vitamins and you have photos of products than you are clear.

just not photo related stuff for sell and no books
 
how lond has the site been down?
 
can't they just shut down any other site that is put up because of the name, kind of like issues with trademark related domains?

because of all the questions that I got on this, I decided the best way is
to post here the letter we got and we can conyinue the discussion from there.
I really don't want anyone to buy the site and than have problems with it.

So here it is :

I am Assistant General Counsel of HarperCollins Publishers Inc. (“HarperCollins”), the owner of the federally registered trademark A DAY IN THE LIFE OF (the “Mark”) and the publisher of the A Day in the Life of series of books (the “ADITLO Series”). To date, HarperCollins has published 16 titles in the ADITLO Series, such as A Day in the Life of America, A Day in the Life of California, and A Day in the Life of Italy, and sold over 1.3 million books.


It has recently come to our attention that you have registered and operate a website located at HYPERLINK "http://www.dayinthelife.org" www.adayinthelife.org (the "Infringing Website"). The Infringing Website employs a domain name that is nearly identical to the Mark and it’s subject matter is indistinguishable from that of the ADITLO Series.


Please take notice that your commercial use of the Infringing Website constitutes "passing off," as consumers may erroneously believe that the Infringing Website is operated in association with HarperCollins, and, therefore, violates HarperCollins’s trademark rights under Section 32 of the Lanham Federal Trademark Act (the “Lanham Act”). Furthermore, your use of the Infringing Website may also constitute "initial interest confusion," which is prohibited by federal law, in that the Infringing Website may draw "hits" by virtue of your use of a domain name nearly identical to the Mark. Each such "hit" misleads persons looking for an officially sanctioned ADITLO site. Lastly, the near identity between the Mark and your domain name and the similarities between the subject matter of the ADITLO Series and the Infringing Website raise substantial issues of the willfulness of your infringement, for which the Lanham Act provides treble damages and the recovery of attorney’s fees and costs.

I have answered 30 Pm on the subject in the last week about this domain.
I think you should be in the clear specially if you use it for linking
purposes.

I will lower the price to 750$ which will also be the bin price

come and grab it
 
Well you have to understand that whoever buys the name must be willing to deal with a potential law suit from that company. Their C&D order states just the use of it can be a problem...

Any traffic stats? (past)
 
also take into account that this is the letter from the publishing com.
cost them nothing to make claims,
will they be able to close a site that deals with something else thus no
chance of someone thinking that it was their products doubtful.
some one using the site just for links: even more doubtful

also there are other sites with that name operating

please no more question about that site I realy dealt with this issue
long enough.

you all have the bin price dont think you will find another PR6 site
listed in yahoo at that price
