Regarding the UDRP (dispute resolution process) would a fake trademark be considered a "bad faith registration" resulting in a transfer of the name to the complainant? If such a complaint was brought would the complainant prevail?

Hi Bob,
by fake trademark I mean non-existant trademark, many individuals (and some ICANN acreditted registrars) were awarded land rush names by afilias after entering bogus tm numbers from countries such as andorra and borra borra island.
