Ok finally find out everything you always wanted to know about the jolly old elf.

What's the value?

I had the owner of Santaclaus.com send me a nasty letter, claiming a trademark and threatening to file an action to take it away from me. Can anyone have a trademark on Santa Claus but for the Xmas dude himself?

But, he said he would rather avoid the hassle and offer me $500.

Should I take it?
 
Tell him its not for sale.
 
I'd take the money and have a happy, hassle-free Christmas Ho, Ho, Ho!
 
Take the money. I doubt many other buyers will make offers. I would think that domain name would only bring in traffic a couple moths out of the year (Nov, Dec) anyway.

I would go for $1k. It will cost him at least $3k to file any legal claim for the domain.

Ya a lawsuit about claiming the ownership of SANTA CLAUS :rolleyes: is gonna cost him way more than $500 :laugh:
 
I checked and he doesn't have a trademark that reflects any exclusive ownership of such a generic term (or so says my IP attorney in a call to him a minute ago). Appears there are several trademarks on the name that reflect drawings etc.

Guy just ticked me off with the threat. If he would have just offered something for it there might not have been a problem. His price just quadrupled. If no go there, I'm going to continue with my plans for development with a call to the North Pole looking for a partner.
 
wasnt the image of santa claus created by coca cola near the start of the 1900's? I definately heard that but it may be an urban legend...

Tell him $1,500.00. He knows he would lose any legal action including UDRP.
