Permission for use detailed below. As yet undeveloped, but I think good candidate for development given the close association of the name with the BBC's trademarks. Recipes, food price comparison shopping, food speciality sales etc...

Legal Permission as written to me:

Dale,

Thanks for your email of 25th February regarding your acquisition of the ukfood.net domain name.

As you may be aware, UKTV owns a number of television channels and associated websites within the "uktv" family. These include "UK Gold", "UK Style", "UK Drama", "UK History", "UK Food" and "UK Bright Ideas". UKTV has built considerable goodwill in all of these names through the operation of its television channels, websites and as a result of considerable marketing.

Specifically in relation to UK Food, UKTV has a television channel called UK Food and currently owns the domain names ukfood.co.uk and ukfood.tv. UKTV has applied for the registration of the trademark "UK Food". In addition, the logo UK Food and other associated branding and marketing materials are protected by copyright legislation. We therefore feel that your proposed use of the Domain Name (as referred to below) could infringe our rights, however we appreciate that you want to pursue your business and appreciate that by your approach you are obviously aware of the potential infringement.

Without limitation to our rights which are expressly reserved, UKTV are happy for you to use the domain name ukfood.net ("Domain Name") in respect of your proposed website business which shall display food prices and food related topics ("Business Venture"), provided you do not infringe UKTV's rights and you sign and return the attached undertaking.

I appreciate that you may want to discuss the above with a legal advisor. On the basis that you agree with the above, I'd be grateful if you could print out the attached undertaking and sign and return the same to me at the address below.

If you want to discuss any of the above, please give me a call.

Regards

<Sender's name snipped for confidentiality>
UKTV
2nd Floor
160 Great Portland Street
London
W1N 5TB

Here are the bones of the undertaking mentioned that needs to be completed:

Dear Sirs,

UK Food.net

I refer to our recent communication regarding the above domain name, which I have registered and in particular your email of 4.4.03 from <snip>. Without limitation to your rights which you have expressly reserved, you hereby confirm that you are happy for me to use the domain name ukfood.net ("Domain Name") in respect of my proposed website business which shall display food prices and food related topics ("Business Venture"), provided I do not infringe your rights and to give you reassurance of the same, I undertake that I (and any future owner of the Domain Name) will not:

1. use the European Trademark E2469278 "ukfood" (or any replacement trademarks) or any similar mark in respect of the proposed Business Venture or otherwise;

2. pass off or attempt to pass off, UKTV and/or UK Food, trade off the goodwill of the same or mislead, misrepresent or otherwise confuse the public that the Business Venture is connected to or associated with UKTV and/or UK Food.

I agree that the above shall not constitute a licence or grant of rights of any sort.

Yours Faithfully

I forget where I bought it (I know who from) and I forget how much I paid for it. Steven, if you're looking, let me know by PM or post here how much I paid for it please :D It was either eBay or from this forum - I'm too old and decrepit to remember :)
