Is it a good idea to use whois protection? Does that mean the company have to actually file a court case to view your whois info? Doesn't that upset the company more than they just send you a C&D letter and ask you to transfer the domain? Which means more trouble for you?

if you're concerned about privacy - set up a US LLC in a state which doesn't require disclosure of ownership, principals or officers. use the llc to offer whois privacy (ie as a proxy / trustee) for an offshore holding company / trust / whatever, which actually owns and controls the domains.

If you consider using "canned" whois privacy from a provider like gopaddy - check out their TOS first to see if it would work for your domains.
