use of .info using TM's? anyone know of wipo decisions yet

ABC whatever company is a .com and owns most likely the .net and most of the tld's

Yet somehow you end up with ABCwhatever.info

Now 'fair use' is a doctrine in TM, where certain uses of a TM is 'fair'

So an informational site on that company by a third party is 'fair' use like a news station can say ABC whatever did this today

Anyone know of .info TMs being used as informational sites with info about the famous TM?

Seems the dreaded 'bad use' won't apply and if you don't 'compete' and merely provide 'news' about them, you should be able to hold the .info and get great traffic from all the people looking for that company

If anyone knows of a wipo saying an exact TM registration can be legit if the 'use' isn't in bad faith and 'informational', a freedom of speech thing

We used to run some WhoeverSUCKS sites, gripe sites, got C&D all the time and my lawyers laughed at them and once they threatened counter claims and defamation, they left us alone. You put TMsucks.com and you can use it, as long as you just griping

So TM.info can you put out 'info' and be 'fair'

Just thought of this, so if some TM mavens are around, great, save me some fees
