1. don't register it in bad faith (too late if you already have of course)

2. don't use it in bad faith

3. make sure you don't sell directly or indirectly the same type of product or service as the TM owner.

Do as I say, not as I do, of course (tongue in cheek).

I would suggest filing a DBA through your local county, and also file for a state TM. In order to lose the name through UDRP, you HAVE to meet three requirements, one of which is that you don't have a legal right to the name. If you can create this, then you should be fine.
