Actually, I am thinking....did you put the "Sold at BIN" in his sales thread or via private communication after the original chat?

Tom, I think you are wrong here, but even if you will be right there is no way to fight here against so called "seasoned or respected domainers". Here people respect each other for domain names they sell, not for some kind of personal qualities. So, if you are dealing with a respected domainer on the forum that doesn't mean that you are dealing with a good person. I think you should keep this in mind when you deal with people on any forum.
I have nothing bad to say against VirtualT, so the above is not in any way directed at him.

just out of curiousity what were the domain names?
Sold at BIN!

Wait a minute, what were the domains again?

Like was said previously, VT does not have to honor your 'bin' offer because you attempted to haggle, you moved on and one minute later, negotiations were over.

I say chalk it up as a learning experience and in the future, if you really want the names, claim them immediately.

Ok guys, I appreciate your responses, I will take in what you have said, and rebut some other points.

Firstly VT did not reply to my acceptance of his price, by this point he was too annoyed because it is really quite difficult to offer a domain and then pull through on your end. Why not just mess me around it is fun. Regardless of my rights to the domain of the haggling process he could have merely responded sorry no longer for sale, in 30 minutes the price has increased.

To wmloz, you may have the bank balance to pay to become an exclusive member but you have no reputation, and being excluive doesn't mean you are a professional. This case shows that, you are in polite terms an idiot.

I would also like to take this chance to point out one thing I have noticed about dnforum members. This is not meant to be offensive, just honest.
You seem to propogate like sheep and blast away the same point. Maybe in this case I am in the wrong, I appreciate that but please for once can members come up with their own opinions, and not joke about serious matters.

Thanks all for your help, obviously I wont get the domains, if you want mods please close this thread. If not leave it open the psychology of some members is an intereting read on its own.
Good luck everyone.

I have posted this so many times. Time is of the essence. If you don't meet the seller's terms at the time the deal is struck then the whole thing is up for renegotiation, whether it be 30 minutes or 30 days hence.

I think the buyer does not know contract law. Haggling will immediate invalidate any offer from the seller. This applies whether you buy a house or a domain.

I learned my lesson a long time ago and have been through this many times..as many of you know I love to deal, and as a result have lost out on many names but have also bought many names for a very good price. The final rule is when the price is offered you can accept and they are contractually bound. IF you try to re-negotiate under their desired pricing and they decline and then you come back and say "OK sold, deal" they do still have the option of course to sell you the domains but in actual case law are not obligated to do so, and I know this for a fact because this has happened to me a few times in xx,xxx range deals in the past and I spoke with my lawyer about it and he researched this exact matter. When you counter offer, you invalidate their price offer because your lower offer is in essence saying that you will not pay what they want for their property that THEY own. After that point they can choose to sell it to you at a second chance or just move on, and usually they just move on. Lesson learned here Tom, good luck and apologize to wmloz, he is a BIG baller in case you did'nt know ;)

Get over it! I can tell just from this thread that you ARE annoying! I wouldn't deal with you either if this is the way you carry on, and on, and on, and on. The domains are HIS and until there is a MUTUAL agreement to buy and sell you have NOTHING. A BIN price means squat unless HE accepts it. Not because you put it out there. The nyou threaten negative feedback, calling the Gods, etc. Do you think anybody really cares? Call the waaaaambulance on the double!

Indeed ... post of the day
especially ..
I can tell just from this thread that you ARE annoying! I wouldn't deal with you either if this is the way you carry on, and on, and on, and on.

Provider, I am really amazed how often my opinion is exactly like yours. :)

Tom, I think the only thing that the seller in this case could do better was to tell you that the name is no longer for sale at the initial price. Except for this politeness issue I don't see any obligation for him.

You seem to propogate like sheep and blast away the same point. Maybe in this case I am in the wrong, I appreciate that but please for once can members come up with their own opinions, and not joke about serious matters.

It's called common sense, that's why it *appears* to be a common front. In fact, anyone advising you otherwise under the given circumstances would have to be classified as black sheep :D

Dude, if everyone is telling you one thing and you are saying the opposite you have to explore the fact that you could be wrong..

Tom,

I dont see too many jokes here - just good advice. Take the good advice for what it is and move on. You nixed the first deal by undercutting and he wan't interested in selling to you after that.
It appears to be very very simple. You took a spin on the wheel and lost. You aren't the only guy ever to have lost a deal by trying to lowball an asking price. Sometimes it works, sometimes it doesn't

But if you lose the deal move on. You lost no money here. And as a sidenote its not good to piss off the seller of a domain you are trying to buy - it makes them very unlikely to sell when they are agitated by a potential buyer ;)

Ahahahahahaa funny joke! Wow, good jokes..heheheh hahahaha  j/k

Lads/Lass',
Half of the dnforum members are absolute legends, I appreciate and take on all your advice.
The other half, are a bunch of twats to be frank.
I have learnt my lesson, I was in the wrong, now the arrogant cocky idiots can stfu and get out of the thread. I was trying to act professionally and get peoples opinions. Some people sadly are too bloody brilliant.
I have explored the fact that I was wrong, I even went as far as saying that I was wrong, hence why this thread can be closed. I AM WRONG, just making it blunt and simple for the uneducated.

In regards to dolansco's post specifically, I can't tell if you are just messing or if you seriously think thi guy is funny. In regards to focus' comment, I will not retract my comment about thi bloke. He may be a big player, but that post makes him out to be an absolute knob.

N.B I have received several PMs supporting nearly every one of my comments in this thread in some way, shape or form.
ome of you guys need to get over yourselves.
POST CLOSED

Hey Tom,
Just to say - please try and calm down. I can appreciate that you are feeling ganged up on now, though. Just try and relax a bit :)

Whilst I would agree that by law/in strict practise, Virtual T didn't have to sell to you, he should have at least contacted you and/or replied to your PMs telling you he's no longer interested. That would have saved a lot of hassle. Although these forums are marketed as being the professional elite amongst DN forums (and I would broadly agree), lack of communication (i.e. replying to PMs) does seem to be a problem - and as such I do have sympathy for you Tom. I've been ignored a couple of times by "big time" members of DNF (one PM was asking for domaining help/advice, the other was asking to buy a domain?!?) and it's no fun.

I just hope that you can put this behind you - domains fun when arguing isn't a factor! :)
Tristan

Seller gives price -seller obligated, Buyer counteroffers , seller no longer obligated.
My 2 cents

jim
I agree with Jim..when you tried to haggle the price down, the contract no longer existed.

Let's all have a round of beers and sing our favorite domain song :D

Input appreciated. I try to stay calm, but some people on this forum... words cannot describe their idiocy.

I suppose with any business you are alway going to get idiots, but I didnt realie there were this many on dnforum..

Ok I admit being an idiot.

Now then, what were the domains? Maybe you saved yourself a few quid after all.

If you offer a lower price than what they told you then it starts negotations again..

Just like on sedo.. if you offer a lower counter the seller can cancel right then and their last offer is no longer valid.

Time to step back and forget about it.. he has no obligation to sell anything to you, this situation has happened to most of us before nothing unusual :)
