Short of being forced to hand a domain over by way of a WIPO proceeding, can any further damages be claimed if a TM owner tries to get a TM domain away from me?

Trademark infringement is a civil matter, If you lose or choose not to fight the case at all, you pay the party who won the case against you. If you don't pay, they can go after your assets, garnish you wages etc.

Civil cases and criminal cases are completely different, there is no criminal punishment in civil cases.... It's all about money and sending the message; "Don't mess with us"

Anyone suggesting TM infringement is punishable by imprisonment is ignorant to the above.

We are long passed the time in this industry when it was wise to hang onto a TM.

Clean your portfolio and drop all tm's while you still can.

Go Daddy has a feature in their cp called 'delete selected', I used to use it in the old days when I got a C&D, it forces the domain into redeption right away. ( HINT: If you use it, change your whois to junk before hitting delete selected.)

GD is the only one I know of that has an instant delete, came in handy a few times.
