why can't they take it away?

Hello,

Another TM question that I do not understand is someone registers a name with the registrar in 2001 and a company registers a TM on the same name for a TV Show. Why or Can they take the name away from the person that registered the name with the registrar because they have that same name TMed? Also the person that registered the name with the registrar is selling the name now.

EDIT: I just noticed that someone has the .TV of the same name registered. The site is up and is not from that TV SHOW. But the name was registered 2001.

EDIT: Nothing comes up at WIPO.
