"Active" is a brand of partition recovery software, so you have TM issues with this one. The tool is freeware, so maybe you could put up a download mirror site and monetize with ads, but still going to take some work and carries risk of TM loss or hassle. Probably mid to high XX reseller, and a few hundred to somebody that want to develop something like this and knows how to successfully.

[active partition] is a common IT term, [recovery] is even more generic. Don't see the TM issue unless one uses the "Active" brand for a similar product or steals the logo for any purpose.

I'd develop it using made-for-humans info and PPC, but filtering out the "active" brand just to avoid any bullying or reverse squatting from them.
