Howard,

Did you have to email them to get the settlement, if yes to what email do we request what's opwed to us?

Thanks in advance,

-=DCG=-

Hey Adam,

They emailed me with the proposed settlement agreement and a schedule with all of the relevant domain auctions. If you do not know who else to contact, then just send an email to [email protected]. OK. Now I see that someone put you onto Rust Consulting. That should work just fine.

I don't blame you...

Would be good to hear from people who have actually received money back though... anyone?

I do not know how quickly they will pay, but most people should take a bit of time to make sure that they feel comfortable with the accounting. I would not expect that anyone has been actually paid yet. We only received the email with the settlement on the 6th. Oversee.net tends to pay people very quickly. In this case, they have every reason to pay people off as quickly as possible.

These idiots (Snapnames) haven't responded to my 3 emails I sent asking for access to my account records from my closed accounts. I have not received any email at all from anyone.

Too bad those losers bailed the forum or maybe I could ask them about this.

Well the thing is this
"Upon receipt of your Rebate Offer Acceptance Agreement and after verification of your eligibility, Rust Consulting will provide your rebate check (or confirm application of account credit) by mail."
There is NO DEADLINE (i.e. "but latest in 30 days"), so basically they can "keep verificating" for a year or two...or forever. So they will have the cake and eat it too...

I have had great difficulty just typing RUST in previous posts insted of RUSTBUCKET!

I would really like to know, though unless someone spills the beans I never will, how much RUST is being paid by Oversee, somehow I doubt it is less than 7 figures.

So what do you reckon, should we not sign the rebate agreement?

Well I personally will wait till some larger payment will be made. I think they might be waiting with the payment till the end of the one year period for signing the agreement.

I have zero interest in a class action lawsuit. Before I take a rebate some things need to be sorted out.

1. Did Oversee report this to law enforcement?

2. How much do they end up clawing back from the Snapnames sellers and is there any insurance recovery?

3. Is halvarez the only Nelson alias?

The rebate only accounts for one facet of how Nelson's actions damaged me. Oversee came up with this rebate formula because if havarez came in second and you came in first havarez clearly had an effect on what you paid.

I think there needs to be compensation for the other damaging Nelson actions. I had 2 auctions where Nelson ran me up a total of $15K and Nelson came in third place. Nelson beating me out on names and not paying also damaged me.

For those 2 scenarios you can't pin down hard figures. That doesn't mean you can't compensate for it somehow. I think they should double what they are offering. I likely was damaged 4X or more so double would be a compromise.

The only way I'd join a class action lawsuit is if a lawyer paid me double the rebate upfront. That's not going to happen. :)

This is a good point and unless the agreement states no further action in any respect can be taken than could you/we not still use based on other issues?

Adam, the email from Rust Consulting details the auctions affected by "halvarez" - and the amount per auction & interest is broken down and totaled, as a separate PDF document.
Can someone post a link to this PDF?

Other than the first notice, I have yet to see any email regarding this mess.

One problem I have is that in the rebate agreement you can't fill in the amount they owe you. So they could just send you $1.

Also what about all the revenue I lost from the hundreds of auctions that it was me and halvarez. Either he bidded or not, but I lost 3 days of PPC revenue for hundreds of names.
500(maybe more) domains x 3 days x $2= $3000

Has there been any determination/discussion on IF this somehow affected names being listed/auctioned that WERE NOT drop auctions?

Hi Virtual,

You should have received a case number when you submitted your email. Please send me your case number or a contact email and I'll have someone track down your request to get you access to the data.

Thanks.
