For Sale Expired Domains - Active Sites?

I've been watching a domain that expired back in August. The owner is a very large and well know company. The weird thing is the domain is still active. They still use it, and the website is up and running. It was registered at Register.com. You would think the domain would be available by now, or at least the website would be inactive. Anybody come across this before?.

all the time jcpenney for instance register. com is way behind in updating the database or pennys. i watched a lot of those to until found out why
