I have been thinking about developing this site for a while and started a while ago.

Registered at namecheap until June 2005 it gets on average 20 hits per day, I had previously discussed its dvelopment with bunkered.co.uk and they were cool with the site, as long as it did not compete with them (as in offer golfing magazines like them).

I have designed a new template for it and you can see it at the site, its just a onepage but comes with psd file and so on.

Looking for $100 for the whole lot, or I will continue to develop, please dont make me any offers as I have researched the name and assocations to other sites and I know what it could turn into.

Sorry but as I said I got the full payment from someone else, we only had an agreement until you said you could not pay the full amount until tomorrow.

The inference in this post is that you are going to pay the $100 as requested and forward to my paypal address.

Then you want to pay 50/50, first payment immediately and second on receipt of domain.

You then state you dont have the money to make the 2nd payment.

:) if you can see a binding contract in there then I would like someone to explain it to me.

Had you rejected my offer to 50/50 then I would expect to pay all now or lose the domain, but you agreed to the 50/50 and I was still willing to meet that.

I am not going to get into a debate over it, you should have made it clear before offering the 50/50 deal that you could not pay 50% until tomorrow, material facts not disclosed prior to acceptance of an offer do not create a contractually binding agreement.

I should know, I am a lawyer ;)

If I am in the wrong here, lesson learned, and I do apologize.

You agreed to be paid tomorrow here.

If he just said :
I will send the first $50 right now, AND send the other $50 tomorrow


Then he is following the agreement still, so how is that breaking the deal
since both statements mean the same?

Just because he said "it suits me I have time to topup paypal" isn't breaking a deal is it?

Lawyers should follow the law not break it.

This was on the basis of $50 at that point, I then transfer and get the other $50 right after.

Only after I stated this did he then say he could not pay the $50 until the next day, its not breaking the deal, as the deal did not exist on the basis of material fact disclosure.

Comments like

Lawyers should follow the law not break it.

only serve to prove you dont understand the law so please dont comment on something you dont understand.

Wise, you said you wanted the username so you could push the name and then go to bed. You then accused domnet he broke the agreement because he replied "ok I'll make the final payment tomorrow".

Do you understand what 50 now 50 after means? It means you don't get the money up front so be careful what you say, and that advice is not only for trading domains.
