Was this domain stolen?

Theo thank you so much for bringing this up! It WAS stolen and I have just lost $700...

What I mean is, was this seller aware of the domain's status?

Thanks Theo, I will give Chris a call to confirm.

I have just been on the phone to Chris Thomas and he did own the name and sold it. He believes Snap Names actually bought the domain but is going to have a look and send me all the info from that sale. I purchased the domain through Alex so I am not sure what the hell is going on here.

Hi, James,

The domain, HKE.NET, was originally purchased fraudulently. It since moved in and out of several moniker accounts. I am assuming that you purchased this domain via a private transaction. When we first discover a fraudulent purchase to be on the safe side we immediately suspend all accounts involved. Once the investigation is complete we then go back and take the appropriate action on the domain and effected accounts.

This domain has been taken back by Moniker and your account has been restored.

I am sorry for whatever inconvenience this has caused you.

Best Regards,

Marti

...
so if this is the reason you couldn't sign in...then another question is when you close someone's account or remove a domain from the account, don't you think you should have been made aware of this right away... hope this all works out James

Exactly. I am transfering all my domains from Moniker and would advise all others to do so too.

Ok just spent 20 minutes on the phone to Moniker who are stating that Alexdon82 stole the domain but I have spoken to Chris Thomas who owned the name before Alexdon82 and he said it was SOLD to stolen?! I dont know what Moniker are playing at and the name is sitting in Monikers account not someone else's? I am getting seriously frustrated now.

Hypothetical situation:

Chris sold the domain to Alex.
Alex sent the payment via non-escrow (paypal) or a compromised / fraudulent account
Chris pushes the domain to Alex
Alex receives the domain, then cancels / disputes the payment transaction

IMO that would qualify it as a "stolen" domain.
