hi, got my first c&d , is that okay to offer them to buy or no?

if so- for how much?

name has no value/no traffic , just .tv extension of the name of the company

they went back with $250 :(

my time, required for transferring the name is more expensive :rolleyes:

I personally try to stay away from other people's trademarks, but that does not mean you will not receive a C&D anyway....people believe they have a right to certain generic terms as well.

Attorneys will usually pay "out of pocket" costs so if you paid X for the name and can prove it then they might pay you X.

However, if you've got a C&D you can treat it as a learning experience but if you are on their radar and really want the name, the lawyers to start digging for more names and tell other companies about other potential trademark names you have etc etc.

If it is confusingly similar, you have no legitimate use for the name and you are using it in bad faith (parking it with ads or offering for sale) then they can take by WIPO.

I'm not a lawyer and you may want to seek legal counsel. There are several in this forum.

I think $1k is the breaking point. Over such amount the other party is getting nervous and may go into polarization mode – than they will most likely spend more just to teach you the lesson (they want blood).

Below such amount it is harder for the lawyer to convince them it is worth to spend some more time, efforts and fees – but you have to make sure – they have to feel you are serious about the transfer and you are not playing any games with them.

You may offer some well established escrow service up-front with 50/50 option – it will give them some comfort.

Typical UDRP case fee (one panelist) cost $900-1300 to initiate, so everything over it goes to the lawyer.

Reassuming – if you are asking $10k – they will file case under UDRP for sure (minimum);
$1k – most likely not, but you have to behave and put down something sort of what you already wrote:

- You were not aware of associated issues
- You regged automatically in bulk by unsophisticated process
- You agree to transfer free of charge – just for the small compensation fee of XXX
- You are ready to start transfer immediately using escrow service of their choice
(you recommend escrow.com, Sedo, Moniker)

Johnn is right. Your time is valuable, so counter offer with $10k minimum. If they do not comply promptly, they are wasting your time, so let them know that the price will soon be $100k. After all, your time is valuable and pushing the domain is an extremely complicated process. :rolleyes:

I think you need to re-read Johnn's post. He is saying that it cost a minimum of 10k to start legal proceedings, not for you to go back and ask them for 10k...your above recommendation is absolutely nutz!:rolleyes:
