What are the legal issues if they win a decision and then let it drop...does that work against them if they file another complaint? Anyone?

From the UDRP decision linked above ...
In light of the foregoing, the Sole Panelist finds that the Domain Name <carreerbuilder.com> at issue is confusingly similar to the Complainant’s trademark "CareerBuilder", that the Respondent has no rights or legitimate interest in respect of the Domain Name and the Domain Name has been registered and used in bad faith.

Consequently, the Sole Panelist decides that the Domain Name be transferred by the Registrar from the Respondent to the Complainant.

Right, that's why they won the first complaint. However, what happens now that they let it drop. If they file another complaint, are they at a disadvantage since they let it drop?

I researched this and there was a UDRP in 2002 and it was awarded to CareerBuilder.com from John Zuccarini. It seems CareerBuilder.com let it drop.

Seems like a lot to spend on such a high risk domain.

The biggest risk here is that the bidding was at Enom.

Once I registered a domain with "bay" in it. Two weeks later, Ebay sent me a warning email (pre-CD). I deleted the domain at the registry. Two months later, someone registered it. Ebay took it away from them and it dropped sometime last year. I won't be picking it up again to find out what happens the 2nd time around :-D

The whois in protected, but people who know how do pass it know who the buyer is.

If anything, the old UDRP win would bolster any new claim.

A panel once found that the complainant had trademark rights.

yep. big disadvantage for sure. but not an insurmountable one. if the new registrant has bad faith the arb will likely award the name back no matter how many times the let it go. one thing tho- the new reg should be able to ask for 33k as out of pocket expense (but no more). maybe some of the lawyers here have an opinion on this one. john? howard?
