Just got this...

We received perhaps the strongest warning letter ever from a law firm that altavita.com is an infringment on altavista.com and that anyone who gets the name will be immediately hit with a UDRP dispute and suit for damages for any time they hold the name, and legal fees. If anyone would like to be removed from the auction or have their existing bid removed let me know. They also listed the current registrar but we have not heard from them yet.

I apologize if you receive this more than once. We are having some email client issues.

Else they won't have an snapnames email! They are so money hungry they still continue with the auction of the name lol. If i was them i would just remove it for god sakes!

Is it worth being sued over a typo! not imho!

If you wanna make sure just give them a call and i am sure they will let you know!

If that came to you direct from Nelson, then it is the real deal. I would back off that auction at once.

Guess that's the problem, did it really come from him or another bidder trying to eliminate the competition?

I really can't believe they would keep the auction going if it was true.

Nelson sent me an email yesterday afternoon. And, here is the ip# it came from.

Received: from snapgate.snapnames.com ([66.195.39.27])

I also received an email from Kjel yesterday. And, his email had the same ip#

Nitro, see if it matches or is similar to the one you received.

Yup, same IP, guess it's legit.

Now the question is why didn't they just stop the auction, they can't be that greedy with all the $$$ they are raking in.

I'm not included in the altavita.com auction. But, I would take his warning seriously.

That is the first time I have heard of them sending out that type of warning.
Also, remember that Kjel is a lawyer.

I just noticed that NOLDC has the net. since 4-04. And, they just renewed it two weeks ago.

Spend a couple of hundred on it, then spend a couple of thousand on laywer costs, then be forced to give the name to altavista.com! Maybe you would feel better giving the money to a charity :-P

Personally Even if it was for $1 i won't bid if i got a threat from altavista!

Maybe, they didn't want to warn you. Just kidding.

The email is probably still circling the globe.

For example, I got 5 confirmation emails from Enom yesterday that were 5 to 7 days old.

What if Snapnames will now sell it at a nice profit in an offline auction? :-D

If anything else, it creates a pre-existing condition where all domains upon expiration are deemed actable upon by anyone around the globe that MIGHT have had reason to believe their tm MIGHT be affected.

I smell big, fat, steamy cow manure.

Occasionally SnapNames will receive notice from a party claiming trademark rights in a domain name that we are auctioning. In this situation we typically will seek to inform bidders in the auction that we have received the notice. While such notice in and of itself is not at all indicative as to any rights in a name, it does show that the noticing party at least thinks they have enough of a case to pay a law firm to formally contact us. This is a fact that potential buyers may want to take into account when weighing their options, and one we feel we should make known to them if possible.

Any domainer knows that it is their sole responsibility to investigate the risk of a potential trademark issue prior to registering a domain, whether via SnapNames or any other method. However, if we have the ability to help a SnapNames customer make a more informed decision about a particular domain purchase, we will always try to do so. Of course if you get this sort of email from SnapNames be aware that it is NOT LEGAL ADVICE: we aren't your attorney, contact your own lawyer for an opinion, etc. etc.

Top, I'm sorry to hear that I'm not the only person getting calls at home from Nelson on Saturday mornings. At least yours was about something important. . . .
