I am quite disturbed about the AriFrance typo squatting ruling!

The problem is... where do you draw the line? If I own Joke.com, am I going to be sued for typo-squatting on Coke.com?? Mike.com sued by Nike.com???

As I'm sure members know, Ari is a legitimate male name! So if your name is a misspelling of a trademark, does that mean you cannot register your own name?

What if Ari Smith lived in France and wanted to register AriFrance.com? BUSTED!

Personally, I think this sets a very disturbing precedant!

IMHO,

Its not the name, its what he does with that name. If you register, MichealJordan.com, type of Michaeljordan.com and curse of the basketball player, you will lose the name in court even if your real name is Micheal Jordan

Even if he were to make a personal homepage out of the site? No commercial use at all, and no advertising?

byalik, although I have not had personal experience, what you say seems to defy logic.

If your name is a mispell of another popular name, that would seem to me to be evidence of good faith!

I am no lawyer, but it would be interesting to hear what Mr Berryhill (I believe that's his name), the domain atty. would say abut this subject!

I'm not an attorney either but I'm sure if your name is Ari and you live in France you might get by with registering arifrance.com but in this case the registrant's name was far from being Ari.

GENEVA (Reuters) - French carrier Air France on Wednesday won the right to take over a Web Site that uses a garbled version of its name apparently to steer business toward other travel firms and some finance companies.

The ruling, the latest in a growing number of "typosquatting" cases, was handed down by the United Nations' World Intellectual Property Organization (WIPO), which runs an arbitration service for Internet name disputes.

Air France -- whose own site is www.airfrance.com -- argued that Alvaro Collazo, the Uruguayan owner of www.arifrance.com, was guilty of "typosquatting," or using a minor variation of its name to divert customers who mistype it.

So.... I guess the result of all this is.... we now have to prove our "worthiness" to reg a domain name IF it happens to resemble some corporation's trademark!

I guess I should not be surprised, sine France is practically a socialist country!

So if I formed a company to sell shoes, and called it Bike Shoes, then regestered Bike.com to sell shoes, I could be sued by Nike and LOSE my domain, because I AM GUILTY of TypoCyberSquatting!

A sad, sad day for capatilism, free trade,,, and the annals of the internet!

This is why there are people who judge these cases.

Although sometimes they seem to be against the squatter.
