when should we fight the TM domain lawsuit ?

When should we decide to fight back the TM domain owner?

Eg. should we just accept for an amount less than the lawsuit fee from the TM owner?
Or we should fight if we think we have a slight chance to win?

Like with any domain, best to accept a reasonable offer.

Reasonable to me is look at what the domain make per month and if you get 24 months revenue up front take it.

Now take it only if you want to and you feel the person has a legitimate right to get the domain.

Now if the domain was registrered before the TM, bargain for whatever you want.

They don't have much to stand on, and make sure you let them know that. It usually pushes them more to negotiate.

I have a current negotiation with a very large record company on latoyalondon.com , they tried to bully me but now realize I owned the name before they TM'd her.

Now we are in negotiations and they will have to settle to get it.

As long as the domain is registered before TM, even if i have no reason to own the domain, they will not get it. This is nice :)
