Will This get Problems? FordFocus.us

I don't see why. Unless of course Ford was the name of a car manufacturer and Focus was the name of a car that they produced. If that's not the case, it looks pretty safe to me. :)

Ford been the manufacturer and focus been the series i would think you definately would have TM issues especialy when new models are still been produced. But thats only a guess!!

I'm aware of someone using a trademarked Ford name in their domain. He'll be declaring bankruptcy soon to avoid all the mess he's in.

From what he told me, and he's dealt with the Ford lawyers quite frequently, you can use the name of a Ford car but not the Ford name, i.e. I can use Mustang in my domains but I could not use FordMustang.

I could start a ocmpany

FordfocUS.us

That is doubtful because of the many car sites out there like MyFordFocus dot com They have never had any issues. I have names like you with Ford and the car name and never had any issues.

The friend explained above must have been using the name in bad faith; therefore, they came after him. Likely case scenario they send you a C&D and you turn the name over to them, but I'm not a lawyer so do as you wish. Just speaking from personal experiences.

Uh huh

Thanks to all that have replyed thus far.

I guess it depends on what you mean by "problems". If you think about it, a lot of people's perceived "problems" are financial ones. For example, you might have a problem figuring out where to invest your money, getting your taxes filed on time, or how to best save for retirement. If you had no money at all, then you wouldn't have any of these problems.

Even the Romans knew well that radix malorum est cupidas, and Buddhists will tell you that you must reach a level of non-attachment to the illusions of this existence in order to escape from suffering which is the inevitable result of an unenlightened life. Jesus said that it is easier for a camel to pass through the eye of a needle than for a rich man to enter heaven, so depending on what you mean by "problems" you are already well on the way to relieving yourself of an eternity of misery.

Wow. Was that John Berryhill channeling Alan Greenspan?

Hmmm.

Im not sure if that post was supposed to help me or just further confuse me.

Let me refraise problem for you.

If I start the site http://fordfocus.us will i get sued.

Is it really worth the risk?

During a lightning storm, do you go outside and hold onto a large flag pole?

There is a slim chance that you will be hit by lightning. But, if you are hit,
you will never forget it, if you live.

If you get on Ford's radar, it will change your mental and financial well being.

Unless you use it in bad faith I doubt anything will happen. As I mentioned there are those who own fordmustang dot net, etc and have never had any issues. If you go and use the name in bad faith, I'm sure Ford wouldn't like that. Keep it clean and you should be safe. I'm not a lawyer so this is just my opinion from holding names like this and using them for sites.

I emailed ford and it says I should be getting something within three business days.

I wish there was a way to know faster.

I assume you wrote to them - asking if you could use this domain?

And, what do you think they will say?

"Sure, go ahead. We really don't care to protect our trademarks."

I'm sorry to sound sarcastic. But, you are being very naive.

When, you use one of their trademarks, you are taking a risk.
When, you use two of their trademarks, they are going to get you.

The exception to the rule is if you use the site to promote a Ford Focus Car Club.
But, you can not show any profit from the site like selling something or having
an adsense strip.

Good move actually. You've protected yourself from litigation and you will know shortly what you need to do.

You've protected yourself from litigation

I'd like to understand your reasons for believing that.

I was out shopping last week and I decided to shoplift. After arriving home with the merchandise, I wrote to the store and asked them if it was okay if I kept it.

What's goofy here is that several people have commented the question is really one of whether Ford would notice or care. Well, they are certainly aware of it now, aren't they?

VERY bad faith. He also had a logo done that's almost identical to the Ford logo ..... and he's still earning income from the site and logo, even though Ford is after him.
